This Marketing Program (“Program”) is offered by SBI Card & Payment Services Ltd. (“SBICPSL”) under an arrangement with Infiniti Retail Ltd.(“Croma”). It is open to all legal residents of India holding a valid and current SBI Credit Card (“Cardholder”) and to whom a communication is sent by SBICPSL and/or Croma.

The Validity of the Program (“Term”) is as mentioned below:

• From 5thOctober till 8^th October 2019,
• From 12thOctober till 15^th October 2019,
• From 19thOctober till 22^nd October 2019,
• From 26thOctober till 29^th October 2019,
• From 2ndNovember till 5^th November 2019.

(both days including) unless extended by SBICPSL and Cromaby mutual consent in writing for a further period “additional term”.

1. All SBI Credit Cardholders excluding SBI Corporate Credit Card with no payment outstanding of more than 30 days are covered under this Program.
2. Under this Program, cardholder can avail:
   1. 5% Cashback at CromaStore & Croma.com
   2. Minimum Transaction Amount: INR 15000. Maximum Cashback: INR 2500per card account during the term onlyi.e across 5^th October 2019 till 5^th November 2019.
   3. Offer shall be applicable on both EMI & No EMI transaction. Please refer to Croma Merchant List for further details.
   4. Offer can also be availed at www.Croma.com
3. Cashback for eligible transactions would be posted by 15.01.2020
4. In case of full cancellation/return of your order, transaction will not qualify for the Offer under this program. If you cancel a part of your order, you will qualify for the Offer only on the net amount you pay on the basis eligibility.

Other Terms and Conditions:

1. The above Offer is by way of a special offer for SBICredit Cardholders only excluding SBI Corporate Credit Cardholdersand nothing contained herein shall prejudice or affect the terms and conditions of the card member agreement between SBICard and their Clients. The terms of the above Program shall be in addition to and not in derogation of the terms contained in the card member agreement.
2. Any query regarding the program will be entertained only till 05.11.2019. Post such date, SBICPSL & Cromawill not entertain any correspondence or communication in any manner whatsoever regarding this Program from any persons.

7. All the existing offers, gifts, discounts etc. that are being offered can be availed by the Cardholders as part of this exclusive offer as mentioned in this communication.

14. All government Levies like Sales Tax, TDS, any Local Tax, Octroi etc., shall be payable by the Cardholder as applicable at the time the respective Programs were offered.
15. This Offer shall be subject to all applicable laws, rules and regulations which are in existence and which may be promulgated anytime by any statutory authority.
16. SBICPSL reserves the right to disqualify the Cardholder(s) from thebenefits of the Offer, if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the said Offer or otherwise by use of the Card subject to intimation to Cromaof such disqualification.
17. Any person availing this Offer shall be deemed to have accepted these terms and conditions

SBICPSL and Cromareserve the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change or vary all of these terms and conditions or to replace, wholly or in part, this offer by another offer, whether similar to this Offer or not, or to extend or withdraw it altogether.
19. Delinquent and over-limit SBICredit card members will not qualify for this Offer.
20. Cardholders are not bound in any way to participate in this Offer. Any participation is voluntary and the Offer is being made purely on a best effort basis.
21. Nothing herein amounts to a commitment by SBICPSL to conduct further, similar or other Offe ₹
22. Any disputes arising out of the Offer between SBICPSL and Cardholder shall be subject to arbitration by a sole arbitrator to be appointed by SBICPSL for this purpose. The proceedings of the arbitration shall be conducted as per the provisions of Arbitration and Conciliation Act, 1996 and amendment thereof. The place of arbitration shall be at New Delhi, India and language of arbitration shall be English. The existence of a dispute, if any, shall not constitute a claim against SBICPSL or Cromaor any of its affiliates.
23. SBICPSL may engage, hire, use the services of agent(s) and/or any third party(ies) for the purpose of providing marketing or sales related services or any other related services in relation to its products on its behalf and the customer may be required to deal with suchagents/third parties/service providers with respect to such product/services.

5. For Retail / POS Transaction : Cashback Offer is valid only on transactions done on Pinelabs swipe machine under 'Brand EMI' option & only if '5% Cashback' is mentioned on chargeslip. Customers are requested to retain charge slip for 180 days post program end date.

12. SBICPSL will not entertain any correspondence regarding the validity or acceptability of any additional benefits offered by Pothys Pvt Ltd on products/services made available by it and the same shall be at the sole risk and consequences of Pothys and without reference to SBICPSL.
13. All government Levies like Sales Tax, TDS, any Local Tax, Octroi etc., shall be payable by the Cardholder as applicable at the time the respective Programs were offered.
14. This Offer shall be subject to all applicable laws, rules and regulations which are in existence and which may be promulgated anytime by any statutory authority.
15. SBICPSL may engage, hire, use the services of agent(s) and/or any third party(ies) for the purpose of providing marketing or sales related services or any other related services in relation to its products on its behalf and the customer may be required to deal with such agents/third parties/service providers with respect to such product/services.

1. DEFINITIONS

For the purposes of these terms and conditions

1. Card" shall mean such variants of SBI Credit Cards which have been issued by SBICPSL (SBI Card & Payment Services Limited) and are valid and subsisting during the Program Period, excluding CorporateCredit Cardissued by SBICPSL.
2. "Cardholder/s" shall mean such customer/s of SBICPSL to whom a Credit Card (excluding Corporate Credit Card issued by SBICPSL) has been issued and who is authorized to hold the Card and who have received the communication from SBICPSL with respect to the Program by way of e-mailer / SMS or any other mode as per the discretion of SBICPSL.
3. "Primary Terms and Conditions" shall mean the terms and conditions applicable to the Credit Card in addition to these Program Terms and Conditions.
4. "Program Period" shall mean the period commencing from October 01, 2019 to October 30, 2019 (both days inclusive).

8. “Gift” shall mean either a Puma Gift Voucher of Rs 1000 redeemable across ‘Full price’ Puma storesor Noise Shots X3 Truly Wireless headphones of MRP Rs 6999 or Xiaomi Mi A3 smartphone (6 GB RAM /128 GB Storage) of MRP Rs 17499 or Holiday Gift Card of Rs 100000 from Makemytrip.com offered by Participating partner/SBICPSL on using theCard during the Program Period. All cardholders are eligible for this program. However, the Gift will be given tothe primary card holder only.
9. “Winner/s” refers to SBICPSL Credit Cardholders who have become eligible for the Gift as per the offer construct and program terms and conditions
10. Void Transaction” shall mean any transaction wherein the transaction made by using the Card has been canceled by the Merchant Establishment prior to settlement with SBICPSL.
11. “Hour” shall mean a period of 60 minutes from 10.00 AM to 10.00 PM as per Indian Standard Time each Day during the Program Period.
12. “Day” shall mean a period of 24 hours from 00:00 hours to 23:59 hours as per Indian Standard Time each Day during the Program Period.

2. OFFER

1. .The Program/Offer is valid only for SBICPSL Credit Cardholders and such cards should remain valid and subsisting during the Program Period, unless otherwise notified by SBICPSL.

E.g If customer "A" & customer "B" both have spent a total of INR 75,000 which is highest spend for that Hour between 10.00 AM to 11.00 AM on 1^st Oct’19, where Card Holder A completed the transaction at 10.01 AM & Card Holder "B" does at 10.11 AM on 1^st Oct’19, Then Card Holder "A" will become eligible for Gift.
   • In case of a tie between two or more Card Holders who have done the highest spends per day, the Card Holder who has taken the minimum time to do the Highest spend during that Day will be eligible for Noise Shots X3 Truly Wireless headphones. E.g If customer "A" & customer "B" both have spent a total of INR 1,00,000 which is highest spend for that Day, where Card Holder A completed the last eligible transaction at 7 PM (from amongst one or more transactions done during the day) & Card Holder "B" completed his last eligible transaction at 4 PM ,then Card Holder "B" will become eligible for Gift.
   • In case of a tie between two or more Card Holders who have done the highest spends per week, the Card Holder who has taken the minimum time to do the Highest spend during that week will be eligible for Xiaomi Mi A3 smartphone (6 GB RAM /128 GB Storage). E.g If customer "A" & customer "B" both have spent a total of INR 1,00,000 which is highest spend for that Week (e.g. 06 Oct to 12 Oct’19 week), where Card Holder A completed the last eligible transaction on 9Oct’19(from amongst one or more transactions done during the week) & Card Holder "B" completed his last eligible transaction on 10 Oct’19, then Card Holder "A" will become eligible for Gift.
   • In case of a tie between two or more Card Holders who have done the highest spends during program period, the Card Holder who has done the Highest spend first during the program period will be eligible for a Holiday Gift Card of Rs 100000 from Makemytrip.com.E.g If customer "A" & customer "B" both have spent a total of INR 200000 which is highest spend during the program period where Card Holder A completed the last transaction at 10.01 AM on 15^th Oct & Card Holder "B" does it on 22^nd Oct, at 11.05 AM, then Card Holder "A" will become eligible for Gift.In case there is still a Tie in the above-mentionedscenario, the sum of last 3 months retail spendswill be taken into consideration to decide program period winner

1. If the Card Holder/s ceases to be the Card Holder/s at any time during the Program period, or before Winner announcement of the Gift, all the benefits under the Program shall lapse and shall not be available to the Card Holder/s.
2. If the Card Holder/s becomes delinquent at any time during the Program period or before winner announcement of Gift, all the benefits under the Programshall lapse and shall not be available to the Card Holder/s.
3. In case customer cancels any transaction/s due to which he/she has qualified for the gift, then the customer is not eligible for the gift.
4. All disputes are subject to the exclusive jurisdiction of the competent courts of Delhi
5. All communication / notices with regard to this Program should be addressed to SBICPSL for SBI Credit Cards. In all matters relating to the Program, the decision of SBICPSL shall be final and binding in all respects.
6. These Terms shall be in addition to and not in substitution / derogation to the Primary Terms and Conditions governing the Card of SBICPSL. All capitalized terms used but not defined herein shall have the respective meanings ascribed to it in the Primary Terms and Conditions.
7. SBICPSL holds out no warranty or makes no representation about the quality, delivery or otherwise of the goods and services offered by the Participating Partne ₹ Any dispute or claim regarding the goods and services must be resolved by the Card Holder/s with the Participating Partners directly without any reference to SBICPSL. The existence of a dispute, if any,regarding the Product/s shall not constitute a claim against SBICPSL
8. SBICPSL shall not be liable in any manner whatsoever for any loss/ damage/ claim that may arise out of use or otherwise of any goods/ services availed of by the Card Holder/s under the Program.
9. SBICPSL reserves the right to modify/ change all or any of the terms applicable to the Program without assigning any reasons or without any prior intimation whatsoever. 10. SBICPSL reserves the right to disqualify/ exclude any Merchant Establishment or Card Holder/s from the Program if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the Program or otherwise by use of the Card.
11. All taxes, duties, levies or other statutory dues and charges payable in connection with the benefits accruing under the Program apart from the TDS under income tax act shall be borne solely by the Card Holder/s and SBICPSL will not be liable in any manner whatsoever for any such taxes, duties, levies or other statutory dues. SBICPSL shall be entitled to deduct or set off the amounts of taxes, etc., if any, mentioned above from all amounts payable by SBICPSL to the Card Holder/s
12. The Program is not available wherever prohibited and / or on merchandise / products / services for which such programs cannot be offered for any reason whatsoever.
13. SBICPSL shall not be held liable for any delay or lossthat may be caused in delivery of the Gift.
14. In the event that the Gifts mentioned above are not available at the time of redemption, then the participating partner will provide an alternate gift of same value. If any alternative Gift is offered, selection of the same shall be at the sole discretion of SBICPSL.

14. All existing offers or discounts etc. that are being offered on Amazon.in can be availed by the Cardholders in addition to this Offer.
15. Cardholders are not bound in any manner to participate in the Offer. Any such participation is voluntary and purely on a best effort basis.

17. Any disputes arising out of the Offer shall be subject to arbitration by a sole arbitrator to be appointed by SBICPSL for this purpose. The proceedings of the arbitration shall be conducted as per the provisions of Arbitration and Conciliation Act, 1996. The place of arbitration shall be at New Delhi for SBICPSL and language of arbitration shall be English. The existence of a dispute, if any, shall not constitute a claim against SBICPSL.

OFFER TERMS AND CONDITIONS:

1. This Marketing Program (“Program”) is offered by SBI Card and Payment Services Limited (“SBICPSL”) under an arrangement with Sangeetha Mobiles India Private Limited (“Sangeetha Mobiles”). It is open to all legal residents of India holding a valid and current SBI/Tata Credit Card (“Cardholder”) and to whom a communication is sent by SBICPSL and/or Sangeetha Mobiles
2. The Validity of the Program (“Term”) is from 29.09.2019 (00:00 hrs) expiring on 29.10.2019 (23:59 hrs),(both days including) unless extended by SBICPSL and Sangeetha Mobiles by mutual consent in writing for a further period “additional term”.
3. All SBI/Tata Credit Cardholders excluding SBI/Tata Corporate Credit Card with no payment outstanding of more than 30 days are covered under this Program.
4. Under this Program, cardholder can avail:
   • Extra 5% Cashback at Sangeetha Mobiles stores
   • Minimum Transaction Amount: INR.10,990. Maximum Cashback: INR.2,000 per card account during the term only.
5. Cashback for eligible transactions would be posted by 17.Dec.2019
6. In case of full cancellation/return of your order, transaction will not qualify for the Offer under this program. If you cancel a part of your order, you will qualify for the Offer only on the net amount you pay on the basis eligibility
7. Additional ‘Manufacturer cashback/discount’ given by the OEM brand will also be applicable on such transactions.
8. EMI transactions will also be applicable under the offer. Any additional cashback given by the manufacturer brand will also be applicable on such transactions.
9. Each transaction will be considered under the best applicable offer, in case the transaction is eligible under more than one offers by SBI Credit Card. In such case, cashback for only one ( best applicable ) offer shall be posted to card account.

Other Terms and Conditions:

4. Any query regarding the program will be entertained only till 31.Dec.2019. Post such date, SBICPSL & Sangeetha Mobiles will not entertain any correspondence or communication in any manner whatsoever regarding this Program from any persons.
5. SBICPSL does not endorse any of the products or brands being offered under the Program and will not accept any direct liability pertaining to the quality, merchantability, fitness, delivery or after sales service of such products which shall be at the sole liability to Great Eastern Retail.

14. This Offer shall be subject to all applicable laws, rules and regulations which are in existence and which may be promulgated anytime by any statutory authority.

SBICPSL reserves the right to disqualify the Cardholder(s) from the benefits of the Offer, if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the said Offer or otherwise by use of the Card subject to intimation to Sangeetha Mobiles of such disqualification.
16. Any person availing this Offer shall be deemed to have accepted these terms and conditions.

The place of arbitration shall be at New Delhi, India and language of arbitration shall be English. The existence of a dispute, if any, shall not constitute a claim against SBICPSL or Sangeetha Mobiles or any of its affiliates.

SBICPSL may engage, hire, use the services of agent(s) and/or any third party(ies) for the purpose of providing marketing or sales related services or any other related services in relation to its products on its behalf and the customer may be required to deal with such agents/third parties/service providers with respect to such product/services.
