3. Mastercard Terms and Conditions

1. Offer details as shown are based on information provided by the Merchant. No warranties are made by Mastercard that the information is correct. Please check directly with Merchant to confirm availability and validity of the Offer.
2. The Merchant is the sole provider of all goods and/or services under this offer. Accordingly, the Mastercard Cardholder understands, acknowledges and agrees that the procurement by him/her of any goods and/or services under this Offer shall constitute a contract solely between the merchant and him/her, and Mastercard is not, nor will become, a party thereto.
3.  By utilizing or attempting to utilize any of the goods and services under this Offer, the Mastercard Cardholder understands, acknowledges and agrees that:
   
   
1.  Any claim, complaint or dispute of any nature arising out of or in relation to the procurement, or attempted procurement by the cardholder of any goods and/or services under this offer (each a “Claim”) shall be settled by the Mastercard Cardholder directly with the Merchant, and Mastercard Cardholder shall not make any Claim against Mastercard.
2.  Without prejudice to the foregoing, and to the fullest extent permitted by law, Mastercard shall not be liable to any person for any loss, damage, expenses or claim (whether direct or indirect) in relation to any personal injury, death, false representation, damage or omission arising from or in connection with the usage or attempted usage of the Offer or goods and/or services provided under the Offer.
   
   
4. Other offer terms

1. SBICPSL does not endorse any of the products or brands or services being offered under the Program and will not accept any liability pertaining to the quality, delivery or after sales service of such products which shall be at the sole liability to Merchant.
2. The Exclusive offers/discounts under these Programs cannot be clubbed with any other offer or discount extended by the participating brands as part of any other arrangement.
3. All the existing offers, gifts, discounts etc., that are being offered can be availed by the Cardholders apart of this exclusive offer as mentioned in the communication.
4. Pictures of products shown in the communication sent to the customer either through mailers or advertised on our website, are representative only and may not bear a resemblance to the actual products. SBICPSL shall under no circumstances be responsible towards the same.
5. Products /services offered under this program are subject to availability from the respective participating outlets of Merchant and accordingly SBICPSL in no circumstances shall be liable for non-availability of any of the products.
6. Under no circumstance will the offer/discount being offered under this Program be settled with cash in lieu by SBICPSL or by Merchant

8. All government Levies like Sales Tax, TDS, any Local Tax, Octroi etc., shall be payable by the Cardholder as applicable at the time the respective Programs were offered.
9. Any disputes arising out of the Offer between the Cardholder and SBICPSL shall be subject to arbitration by a sole arbitrator appointed by SBICPSL for this purpose. The proceedings of the arbitration shall be conducted as per the provisions of Arbitration and Conciliation Act, 1996. The place of arbitration shall be at New Delhi and language of arbitration shall be English. The existence of a dispute, if any, shall not constitute a claim against SBICPSL.
10. Cardholders are not bound in anyway to participate in the Programs. Any such participation is voluntary and the same is being made purely on a “best effort basis”.
11. SBICPSL reserves the right to modify or change any of the terms and conditions applicable to this Program or cancel the entire or partial offer at any time without prior notice to the cardholders.
