Privilege Circle Program - Terms & Conditions
  1. SBI Cards & Payments Services Private Limited (hereinafter referred to as the “ SBICPSL ”) offers to its certain existing customers, who have been issued a SBI Card (hereinafter referred to as “ Card member ” ) a SBI Card Privilege Circle Program facility (hereinafter collectively referred to as “ The Program ” ) upon fulfillment of certain terms and conditions, including the terms and conditions defined herein below, read concurrently with the terms of the SBI Card member Agreement and such other terms and conditions that the SBICPSL may deem fit and proper at its sole discretion.

  2. The Program offers the Card member each of the applicable services (collectively referred to as “Facilities” and individually as “Facility”) defined herein below .

  3. Privilege Circle Offers: Regular special value offers on travel, shopping, dining, utility bills, fuels etc to help Card member(s) get the enhanced value from their various purchases.

  4. This Program is subject to fulfillment of the following conditions by the Card member(s):-
    a. Amount of Charges payable shall be intimated to the Card member(s) in the monthly credit card statement sent to the Card member(s), on the cardholders subscribing to SBI Card privilege Circle Program.
    b. The participation of Card member(s) in this Program is voluntary and being extended on best efforts basis to the customers.
    c. Once the participation of Card member(s) in the Program is confirmed and a consent has been given for availing the various offers under this Program, SBICPSL is authorized to charge for the Program till cancellation/ termination of the Program for any reason whatsoever or maturity thereof, whichever is earlier.
    d. In this regard SBICPSL's program partner PLAT5 CONSULTANCY PVT LTD (hereinafter “ PLAT 5”) shall debit the Card Member's Credit Card account with an amount equivalent to the defined fees connected with the program.
    e. The Program may be availed by the Card Member(s) by providing the SBICPSL's program partner with a list of information required for billing the customer, including but not limited to a valid card number, and expiry date on a secured IVR or billing gateway etc.
  5. SBICPSL may provide through PLAT 5 to such Card Member(s) who avail the Facilities under the Program, lifestyle offers and gifts.

  6. In this regard it is specifically stipulated herein that SBICPSL is neither responsible nor is liable towards the quality of goods/ services offered as gifts, any defect or deficiency therein, SBICPSL shall not entertain any claim in respect of or arising out of non-use or use of, the said products/services/gifts. The pictures/description of the prizes shown in the mailers/ communication sent to the Card Member(s) are representative only and the prizes are subject to availability from the respective suppliers and may be suitably replaced by PLAT 5 in case of non-availability from the respective suppliers, by SBICPSL through PLAT 5 while acting at its sole and absolute discretion. The offers/ gifts are non-transferable and cannot be encashed.

  7. The term(s) and condition(s) contained herein shall be read in conjunction with the scope of cover/terms and conditions contained in the Program. However, the terms and conditions contained in the Program shall stand modified and/ or supersede the terms and conditions contained herein. In addition to the above, it is further clarified that SBICPSL shall alert the respective Card Member(s) through media such as monthly statements and/or e-mail and/or SMS, etc. SBICPSL shall at no point of time be obligated and/or held liable in any manner whatsoever, especially on account of fault in the service of designated third parties and/or service providers which may include non-delivery of SMS, over-quota e-mail account, network disruption, claims on account of gifts receivable, etc.

  8. Any claims seeking reversal and/or charge-back of the amount paid to the SBICPSL under the Program for any reason whatsoever including upon the occurrence of the aforesaid events, made by the Card Member(s) will not be entertained by the SBICPSL under any circumstances.

  9. The usage of the Program shall be strictly in accordance with applicable law, bye laws, notifications , including any amendment, modification or re-enactment thereof.

  10. SBICPSL reserves the right to refuse, revoke and/or discontinue the Facilities under the Program to any Card Member(s) without having to cite any particular reason and/or any other obligation towards the Card Member(s). Further, for the provisions of the Facilities, the Card Member(s) may be contacted by the SBICPSL and/or its associates, designated third parties, through various medium, including but not limited to e-mails, SMS, monthly statements, etc. It is further clarified that the acceptance of providing the Facilities by the SBICPSL is not a conclusive obligation as the designated third parties, partners and/or service providers may further choose to reject the request of the Card Member. In such an event, the SBICPSL shall communicate the aforementioned to the Card Member without having to cite any reason and/or any other obligation whatsoever.

  11. The welcome kit and  other products will be dispatched  to the eligible customers within fifteen (15) working days of his/her sale and consequent booking  being accepted. All resposibility in such dispatch shall vest squarely with PLAT5 and SBICPSL shall not have any role, liabilities and responsibilities in this regard.

  12. SBICPSL reserves the right at any time and without prior notice to add, alter, modify, change or vary all or any terms and conditions and attached offers of the Program. Nothing contained herein amounts to a commitment by the SBICPSL to conduct further, similar or any other scheme. Further nothing herein shall in any manner hold the SBICPSL responsible or liable towards the quality of service/ products and/or satisfaction of Card Member(s) especially in the event wherein the aforesaid services/products are not provided directly by SBICPSL.

  13. The Card Member(s) shall not hold the SBICPSL responsible for or liable for any action, claims, demands, losses, damages, cost, charges and expenses which the Card Member(s) may suffer, sustain or incur by means including but not limited to revocation, non-sanctioning or cancellation of this Program, non-delivery of gifts, etc.

  14. Any taxes or liabilities or charges payable to the Government or any other authority or body which may arise or accrue to a Card Member for availing the Facilities under Program or the gifts received from Contests or services incidental to or connected with the Program shall be borne directly by Card Member or billed to the account of the Card Member.

  15. All complaints, related to Holiday and Flight offers, shall be addressed directly to PLAT5 at Heritage Holidays, c/of Plat 5 Consultancy Pvt Ltd. F 138 First Floor, Rajouri Garden, Main Mkt, New Delhi, 110027.

  16. All disputes, if any, arising out or in connection with or as a result or the scheme or otherwise relating hereto shall be subject to arbitration by a sole arbitrator appointed by SBICPSL for this purpose and shall be conducted in accordance with the Indian Arbitration and Conciliation Act, 1996. The place of arbitration shall be New Delhi and the language of arbitration shall be English. Existence of a dispute shall not constitute a claim against SBICPSL.
