Description of Service
SBICPSL currently provides users with information on details about Card account and transaction and payment history. You understand and agree that SBICPSL assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or provide the Services.


Limited License
SBICPSL authorises you to view and download the Material on this Site only for your personal, non-commercial use. Subject to the terms and conditions set forth in this Agreement, SBICPSL grants you a non-exclusive, non-transferable, limited right to access and use this Site and the information thereon. You agree not to interrupt or attempt to interrupt the operation of the Site in any way. By providing any such information other than Confidential Information to SBICPSL, you grant to SBICPSL an unrestricted, irrevocable, worldwide, royalty-free license to use, reproduce, display, publicly perform, transmit and distribute such information other than Confidential Information. SBICPSL is free to use any ideas, concepts or know-how that you or individuals acting on your behalf provide to SBICPSL. You further recognize that SBICPSL does not want you to, and you warrant that you shall not, provide any information to SBICPSL that are defamatory, threatening, obscene, harassing, or otherwise unlawful, or that incorporates the proprietary information of another without license. Indemnity

Modifications to Service
SBICPSL reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that SBICPSL shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.


Breach
You agree that your failure to abide by any provision of this Agreement or your willful provision of inaccurate or unreliable information as part of the application process, or your failure to update your information to keep it current, complete or accurate, or your failure to respond for over fifteen (15) calendar days to inquiries from us concerning the accuracy of the contact details associated with your application may be considered by us to be a material breach for which we may terminate the Service you are using without further notice. Any such breach by you shall not be deemed to be excused simply because we did not act earlier in response to that, or any other breach, by you.


Communications with customers and customer related information
On request by a customer, SBICPSL will provide credit card statements, customer service requests, payment assistance, marketing information, card account information and new product information through the email. In the event a customer does not wish SBICPSL to communicate with them through email, the customer may discontinue this method of communication by instructing SBICPSL in writing to do so. SBICPSL retains the right to provide information regarding related products which SBICPSL feels may be of interest to customers.


Termination
If you violate any term or if SBICPSL has grounds to believe that you have violated any term of this TOS, we may terminate your access to the Service or any part thereof without waiving any other rights.


Governing Law & Jurisdiction
The TOS and the relationship between you and SBICPSL shall be governed by the laws of India. You and SBICPSL agree to submit to the personal and exclusive jurisdiction of courts at Delhi. This Site is controlled, operated and administered by SBICPSL from its offices within India. The Information and the products available on this Site are available in India for Indian users only and are subject to all applicable Indian Laws and Regulations. SBICPSL makes no representation that Information at this Site are appropriate or available for use outside India. This Usage Agreement shall be governed by the laws of India, without giving effect to its conflict of laws provisions. Subject to the foregoing, if you access this Site from locations outside of the India, you are responsible for compliance with all local laws.


General Information
SBICPSL's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of SBICPSL's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Service or information provided to or gathered by SBICPSL with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. You agree that no joint venture, partnership, employment, or agency relationship exists between you and SBICPSL as a result of this agreement or use of the Service. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and SBICPSL with respect to the Service and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and SBICPSL with respect to the Service. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. You agree that any cause of action arising out of or related to this Service must commence within one (1) year after the cause of action arose; otherwise, such cause of action is permanently barred. The failure of SBICPSL to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision. Your rights under this TOS are not assignable. Any attempt by you to assign your rights shall render this TOS voidable at our option. Any attempt by your creditors to obtain an interest in your rights under this TOS, shall render this TOS voidable at our option. We, in our sole discretion, reserve the right to refuse to provide you the Service without assigning any reasons whatsoever. You agree that we shall not be liable to you for loss or damages that may result from our refusal to provide you the Service. You agree that the Service shall be provided at the sole discretion of SBICPSL and that the credit card approval is subject to credit verification and the submission of necessary documents. The section titles in the TOS are for convenience only and have no legal or contractual effect.
